The fourth part of Legislative Decree no. 152 dated 3 April 2006 as amended, governs waste management and the remediation of contaminant sites, also as implementation of EC directives, prescribing measures aimed at protecting the environment and human health and preventing or reducing the negative impacts of waste production and management.
The essential cornerstones in waste management are the principles of precaution, prevention, sustainability and proportionality, as well as the polluter-pays principle.
Additionally, of fundamental importance is respect for the general hierarchy that involves above all prevention, and secondly preparation for re-use, or if not recycling or recovery of another kind, for example the recovery of energy, disposal being merely a last resort.
To ensure compliance with the concepts imposed by the law, in many cases it may be that the optimum solution for your waste is transboundary movement to EU or non-EU countries as provided for by regulation no. 1013 dated 14 June 2006 which implements in the European Union what is provided for at world level by the Basle Convention.
